While Ian Promoting his New Show V Wars On Netflix he had Interviewed with TV Guide Before Ian Said that Damon was Alife in Legacies Timeline but Now in This Interview, he revealed that his Character died as Human so he can't be back on the show
When TV Guide Asked him about Damon Return he Said Damon is Alive so he can come back Damon said no he is dead now after he becomes human he died and goes to heaven with his Brother Stefan

The Actor is not Wrong We seen in The Last Moment in the Show That Damon and Elena was Reunited with their Families in Peace after they died Those last moments provide us with Beautiful Shots While Elena Meets her Parents And Damon Meets his younger Brother Stefan Salvatore in Peace after 8 Season The Show was Running but in the end, they all find Peace So, Elena and Damon Are Dead which makes Damon can't come back on the Show
